DMCA Notice & Takedown Policy

RC Paddock, operator of rc-paddock.com (the "Service"), respects the intellectual property rights of others and expects its Users to do the same. We respond to clear notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. §512.
1. Filing a DMCA takedown notice
If you believe that material on the Service infringes a copyright you own (or are authorized to act for), send a written notice to our Designated Agent. To be effective, your notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list).
- Identification of the material that is claimed to be infringing, with information reasonably sufficient to allow us to locate it. Include the full URL of the listing, photo, or content on rc-paddock.com.
- Your name, address, telephone number, and email address.
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.

Submit notices by email. Notices that do not include all of the required elements may not be actionable. Sending a notice does not guarantee that the material will be removed; we evaluate each notice in good faith.
3. Counter-notice
If you believe material you posted was removed in error or as a result of misidentification, you may submit a counter-notice to the Designated Agent. To be effective, your counter-notice must include:
- Your physical or electronic signature.
- Identification of the material that has been removed and the location at which it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and email address.
- A statement that you consent to the jurisdiction of the federal district court for the State of Nebraska, USA (or, if you are outside the United States, any judicial district in which RC Paddock may be found) and that you will accept service of process from the person who provided the original notice or that person's agent.
Upon receipt of a valid counter-notice, we may forward a copy to the original complainant and, unless the complainant notifies us within ten (10) business days that they have filed an action seeking a court order against you, we may restore the material between ten (10) and fourteen (14) business days after receipt of the counter-notice.
4. Repeat-infringer policy
In accordance with the DMCA and other applicable law, we maintain a policy of terminating, in appropriate circumstances, the accounts of Users who are determined to be repeat infringers. We may also limit access to the Service or terminate the accounts of any Users who infringe any intellectual-property rights of others, whether or not there is any repeat infringement.
5. False claims
Under 17 U.S.C. §512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake or misidentification, may be liable for damages. Do not make false claims.
