Terms of Service

Welcome to RC Paddock ("we", "us", "our"), operator of the website at rc-paddock.com (the "Service"). By creating an account or using the Service you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, whichever is greater) to create an account. You represent that the information you provide on signup is accurate and that you will keep it current. We may refuse service, terminate accounts, or remove content at our discretion.

2. The Service

RC Paddock operates a peer-to-peer marketplace for radio-controlled vehicles, parts, and accessories. We provide listing, messaging, offer, and order-tracking tools that connect buyers and sellers ("Users"). We are not a party to any transaction between Users. We do not take possession of items, hold funds in escrow, or guarantee that any listing is accurate, that any User will perform their obligations, or that any item will match its description.

3. Accounts and security

  • You are responsible for all activity under your account and for keeping your password and any two-factor credentials confidential.
  • We encourage sellers to enable two-factor authentication; sellers who do receive a Verified seller badge on their profile and listings.
  • Notify us at support@rc-paddock.com of any unauthorized use of your account.
  • One account per person. We may suspend duplicate or fraudulent accounts.

4. Listings and seller obligations

  • Sellers warrant that they own the items they list, have the legal right to sell them, and that listing descriptions, photos, and specifications are accurate.
  • Prices are in US dollars (USD). Stated prices, shipping costs, and any offer amounts are binding once an offer is accepted.
  • Once an offer is accepted, a frozen snapshot of the listing terms is attached to the resulting order. Sellers must ship the item described in that snapshot.
  • Sellers must mark orders as shipped, provide a valid tracking number from a supported carrier (USPS, UPS, FedEx, or DHL), and ship within the timeframe stated on the listing or as otherwise agreed.
  • Listings must comply with the Acceptable Use Policy.

5. Offers, orders, and payment

  • Buyers may make at most one pending offer per listing. Offers expire after seven (7) days if not accepted, rejected, or countered.
  • Accepted offers create an order that progresses through defined states (awaiting payment → payment sent → paid → shipped → delivered → completed). Cancellations after payment require seller cooperation.
  • Payment is handled directly between buyer and seller. RC Paddock does not process payments, hold funds in escrow, or mediate disputes. Users are solely responsible for vetting their counterparties and choosing a payment method they trust.
  • If a transaction goes sideways, you may flag the order as disputed within fourteen (14) days of delivery. RC Paddock does not mediate, arbitrate, or otherwise resolve disputes between Users. The dispute flag exists to (a) signal status to the parties involved, (b) preserve the listing snapshot and order timeline, and (c) inform future moderation decisions if a pattern of bad-faith conduct emerges. Resolution is between buyer and seller.

6. Reviews

Buyers and sellers may leave reviews after an order completes. Reviews are hidden from both parties until both have submitted or until fourteen (14) days have passed. Reviews must be honest, factual, and free of personal attacks, threats, or information that identifies third parties. We may remove reviews that violate these Terms or the Acceptable Use Policy.

7. User content

You retain ownership of the photos, descriptions, setup sheets, messages, and other content you submit ("User Content"). By submitting User Content, you grant RC Paddock a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (for the purpose of generating image variants and thumbnails), display, and distribute that User Content for the purpose of operating and promoting the Service.

You represent that you have the rights necessary to grant this license and that your User Content does not infringe any third-party rights.

8. Fees

Use of the Service is currently free. We reserve the right to introduce fees in the future with at least thirty (30) days' notice via in-app notification or email.

9. Prohibited conduct

You agree not to use the Service in violation of the Acceptable Use Policy. Violations may result in content removal, account suspension, or permanent ban.

10. Intellectual property and copyright

We respect copyright. To report content you believe infringes your copyright, follow the procedure in our DMCA Policy.

11. Termination

You may delete your account at any time from Settings. We may suspend or terminate your account if you breach these Terms, the Acceptable Use Policy, or if we are required to do so by law. Sections of these Terms that by their nature should survive termination (including content license, disclaimers, limitation of liability, and dispute resolution) survive.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY LISTING, USER, OR ITEM IS LEGITIMATE, SAFE, OR AS DESCRIBED.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RC Paddock AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE WILL NOT EXCEED ONE HUNDRED US DOLLARS (USD $100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS OF LIABILITY; TO THE EXTENT ANY LIMITATION IN THIS SECTION IS HELD UNENFORCEABLE, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

14. Indemnification

You agree to defend, indemnify, and hold harmless RC Paddock from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your User Content, your transactions with other Users, or your violation of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Nebraska, USA, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in the State of Nebraska, USA, and you consent to personal jurisdiction in those courts.

16. Changes

We may update these Terms from time to time. Material changes will be announced via in-app notification or email at least seven (7) days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
